General Terms and Conditions (GTC) of the asscociation ErkenntnisWerkstatt - Förderung von altem Wissen (DiscoveryWorkshop - Promotion of ancient knowledge)
1. scope of application
These General Terms and Conditions (GTC) apply to all contracts concluded via all websites of the ErkenntnisWerkstatt - Förderung von altem Wissen association. The association offers the following services:
Online courses, seminars, workshops and lectures (digital and physical events)
Accompaniment
Uniquely handcrafted leather products,
Photography services,
Planning for 3D constructions.
The GTC regulate the rights and obligations between the ErkenntnisWerkstatt - Förderung von altem Wissen association and the customers.
2nd contract partner
The contractual partner is the ErkenntnisWerkstatt - Förderung von altem Wissen association, represented by the board in accordance with the association's statutes. The customer is the natural or legal person who books services or orders goods via the website.
3. conclusion of contract
The presentation of products and services on the website constitutes a non-binding invitation to submit an offer (Invitatio ad offerendum).
By sending the order, the customer submits a binding offer to conclude a contract.
The contract is concluded as soon as the ErkenntnisWerkstatt - Förderung von altem Wissen association accepts the customer's offer by means of an express confirmation (e.g. by e-mail).
4 Prices and terms of payment
All prices are quoted in euros (€). According to § 6 para. 1 Z 27 UStG (Value Added Tax Act), the services of the ErkenntnisWerkstatt - Förderung von altem Wissen association are exempt from VAT.
Payment is made according to the payment methods specified on the website (e.g. credit card, PayPal, bank transfer).
For online courses, seminars, workshops and lectures, payment is due before the start of the event.
For customized leather products and other physical products, payment shall be made in accordance with the conditions specified in the order process.
5 Cancellation conditions for lectures and seminars
The customer may cancel booked lectures and seminars. The following cancellation fees apply:
Cancellation up to 4 weeks before the event: 25% of the total price,
Cancellation up to 14 days before the event: 50% of the total price,
Cancellation up to 7 days before the event: 80% of the total price,
Cancellation less than 7 days before the event or no-show: 100% of the total price.
Cancellation must be made in writing (e.g. by e-mail). The date of receipt of the cancellation by the ErkenntnisWerkstatt - Förderung von altem Wissen association is decisive.
6. delivery and shipping conditions
Physical products (e.g. leather products) will be delivered within the specified delivery periods.
The shipping costs are communicated transparently to the customer during the ordering process.
For digital products (e.g. access to online courses), the customer will receive access credentials or download links via e-mail after payment is received.
7. right of withdrawal according to FAGG
The customer has the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period begins on the day of contract conclusion (for goods) or receipt of goods.
In the case of services (e.g. online courses, seminars), the withdrawal period begins on the day of contract conclusion. If the customer makes use of the service before the end of the withdrawal period, the right of withdrawal expires.
The right of withdrawal does not apply to:
Uniquely crafted leather products,
Digital products (e.g. downloads), provided they have already been downloaded or streamed,
Services that have been fully performed and whose start the customer explicitely requested before the withdrawal expired.
8 Warranty and liability
The ErkenntnisWerkstatt - Förderung von altem Wissen association is liable for material defects and defects of title in accordance with the statutory provisions of Austrian law (ABGB).
The association assumes no liability for damage caused by improper use of the services or products offered.
Liability for slight negligence is excluded unless essential contractual obligations have been violated.
9. data protection
The ErkenntnisWerkstatt - Förderung von altem Wissen association processes personal data in accordance with the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act (DSG).
The privacy policy, which can be viewed on the website, regulates the collection, processing and use of personal data.
10. provisions of association law
The association ErkenntnisWerkstatt - Förderung von altem Wissen acts in accordance with the provisions of the Austrian Association Act 2002.
Membership of the association is not a prerequisite for the purchase of services or products via the website.
11. final provisions
The law of the Republic of Austria shall apply. In particular, the ABGB, the FAGG and the Associations Act are applicable.
The place of jurisdiction for all disputes is the registered office of the ErkenntnisWerkstatt - Förderung von altem Wissen association.
Should individual provisions of these GTC be invalid, this shall not affect the validity of the remaining provisions.
12. changes to the GTC
The ErkenntnisWerkstatt - Förderung von altem Wissen association reserves the right to amend these GTC at any time. Customers will be notified of any changes in good time before they come into force. If the customer does not object to the change, it is deemed to have been accepted.
